The Law Commission last sought views about these topics in 2017. 

This month, the Law Commission published a supplementary consultation Making a Will: A Supplementary Consultation Paper. The consultation revisits two issues:

  • electronic wills, and
  • marriage revoking a will.

On their website, the Law Commission explains the reason for the consultation by citing developments since 2017 that have likely altered the views of interested parties.

These developments include: the pandemic necessitating a greater uptake in digital wills, and greater awareness around predatory marriage.

The public consultation lasts until 5 December 2023, and we will aim to submit our own response in the coming weeks.
