The Ministry of Justice (MoJ) has announced that the controversial probate fee increase will no longer take place on 1 April 2019.

The statutory instrument (SI) bringing the revised probate fee scheme into force would not be laid at the end of March. A MoJ spokesperson said the reforms would come into force ‘as soon as possible’ but that Brexit matters were taking precedence.  

Under the government’s plans, which we oppose, probate charges would be linked to the size of the estate. The wealthiest estates (those valued at more than £2m) would be charged £6k. The current flat fee is £215, or £155 for those applying through a solicitor.
