This presentation will help you to gain an improved understanding of the CMA’s enforcement work, and the rationale behind its procedures and policies. It will aim to provide practitioners an insight into why the CMA runs its investigations in the way it does, to assist in navigating the CMA’s processes and explaining them to clients. It will look at the importance of the public law framework in which the CMA operates, its historical foundations and the practical implications for your casework.
Our speakers will review:

- What is the impact on current and future enforcement: the CMA’s public law obligations as explained in case law and expressed in CMA procedure

Claudia Berg and James Wright, Competition and Markets Authority
- Claudia Berg is the senior legal director of Antitrust Enforcement at the Competition and Markets Authority. Her previous role was at the CMA’s predecessor organisation, the Office of Fair Trading, as a director of Competition Enforcement and head of the OFT’s Enforcement Academy. Prior to that, Claudia spent eight years in the competition practice of Linklaters, London. Claudia is a dual-qualified solicitor (England & Wales and Germany), and holds Master of Law degrees from King’s College, London, the University of Paris I (Panthéon-Sorbonne) and the University of Cologne, Germany. During her early legal training, Claudia spent time in Brussels as a stagiaire at the European Commission.
- James Wright is a legal adviser at the CMA. Prior to joining the CMA’s Legal Service, he was an associate in the Competition practice at Slaughter and May.
