The Law Society has responded to an open call for information, proposals and views from the Council of Europe’s Committee of experts on the reform of the European Court of Human Rights (DH-GDR).
The open call was for information, proposals and views on the issue of the longer-term reform of the system of the European Convention on Human Rights and the European Court of Human Rights.
The Law Society’s paper has been prepared by the Law Society’s Human Rights Committee. The paper focuses on Judicial interpretation. Judicial interpretation is a subject that is extremely relevant as it raises the question of the remit of the European Court of Human Rights (‘the Court’) to challenge the powers of government, for instance to consider prisoners’ voting rights.
The results of the open call will eventually be included in a report of the Steering Committee for Human Rights (CDDH), to be submitted by 15 April 2015 to the Council of Europe Committee of Ministers.
