I am acting for a client on the purchase of a commercial property. The seller’s solicitors have asked me whether I would agree to adopting the Law Society’s Code for Completion by Post 2019. Can we adopt the Code in a commercial conveyancing transaction?
Yes, the Code provides a voluntary procedure for postal completion for either residential or commercial transactions. If the use of the Code is agreed you must be satisfied that adopting it will not be contrary to your client’s interests. Any variations to the Code should be agreed by the parties.
