Land Registry has added a new direction to the Land Registration Rules 2003 giving guidance on applications by means other than post, document exchange (DX) or personal delivery. The direction is effective from 7 September 2015.
The new direction relates to first registration applications where title documents are unavailable, or title is claimed by reason of adverse possession of unregistered land.
If such application comprises only:
• a form FR1, and
• a statutory declaration or statement of truth in support of it (with or without exhibits), and
• a plan,
or if it comprises form FR1 and the statutory declaration or statement of truth without a plan, the applicant may lodge certified copies of the documents, including the statutory declaration or statement of truth and any exhibits, instead of the originals.
The originals or certified copies of the statutory declaration or statement of truth and other documents will be destroyed after being scanned at Land Registry.
