From today (29 June 2015), a new Land Registry form to support an application to cancel a form A restriction can be used. The new ST5 form can act as a statement of truth in support of an application to cancel a form A restriction.
Before cancelling a restriction in form A in the proprietorship register, Land Registry must be satisfied that the restriction is no longer required. This will often be because the land is no longer subject to a trust. A trust of land exists when the formal ownership of the land is separated from the underlying ownership.
Land Registry will also be publishing a new edition of practice guide 73: Statements of truth, and updating its guidance on joint property ownership to take into account the introduction of the new form.
