Office of the Public Guardian (OPG) has introduced guidance on professional deputy costs in partnership with the Senior Courts Costs Office, outlining good practice for professional deputies when charging fees to client accounts.
OPG has created the guidance to help professional deputies when submitting estimates of costs and bills for assessment, and to explain what can be claimed for general management bills.
OPG will ask professional deputies to submit a breakdown of the deputyship costs and fees, as well as an estimate for the following year on the professional fees insert (OPG105).
Within the guidance, professional deputies are advised to apply reasonable fees which are proportionate to the client’s estate.
Information collected will enable OPG to form an opinion about the deputy’s management of the client’s financial affairs and their proposals for future activity.
Its findings will feed into its supervision procedures and allow it to better support deputies and ensure they are acting in the client’s best interest.
