The Law Society has met with HM Court and Tribunal Services (HMCTS) regarding a review of the probate service.

Below, we outline some key details from the meeting.

HMCTS stressed that the probate service is not experiencing delays but recent articles suggesting this is the case can push people to contact HMCTS, placing the service under unnecessary pressure.

Workload

The HMCTS weekly management information table gives statistics on the probate workload, showing what’s gone in and what’s gone out.

Turnaround times

Uptake in the digital service has been increasing week on week since May 2020.

Digital applications are being addressed chronologically and should come out in day order.

Paper applications may take longer.

Going forward

Trust corporations are HMCTS’ next priority and it is hoping to address these in August.

For the digital service, users will receive a notification that their application has been received.

It is advised that you do not apply for grants until 15 days after sending the forms to HMRC.
