On 10 September 2019, we met with HM Courts and Tribunals Service (HMCTS) to review delays to the probate service.

Following our last meeting on 27 June, we asked Law Society members for examples of delays that go beyond the six to eight week timeframe as stated by HMCTS.

This was to find out the extent of the delays and how they are impacting our members and their clients. Common recurring themes came out including:

  • lack of communication
  • errors made by HMCTS
  • property transactions being impacted
  • financial pressures.

HMCTS acknowledged these issues and apologised for the impact these are having on the profession and their clients. We’ll continue to engage with them to improve the probate service.

Our summary includes updates on timescales and resourcing, ‘stops’ and communications.

We’ll be meeting again at the beginning of October at the new Courts and Tribunals Service Centre in Birmingham.
