From 20 January 2020, legally represented parties must use the government’s e-filing service to start and/or continue any relevant claims, detailed assessment proceedings or applications for Senior Courts Costs Office matters.

The e-filing service has been available for voluntary use in the Senior Courts Costs Office from 7 October 2019.

HM Courts & Tribunals Service has realised guidance for professional court users

Practice Direction 51O has been amended to reflect this change.

Records held on the e-filing system

Electronic records have been created on the following cases and these will be known as ”existing cases” going forward:

  • all Court of Protection bills of costs (whether filed before or after 7 October 2019)
  • any new bills of costs, applications or appeals filed on or after 8 July 2019 for the following areas:
    • applications
    • between the parties
    • criminal appeals
    • legal aid.

Records which still need to be filed manually

Papers for proceedings filed before 8 July 2019 are not on the e-filing system and will need to be filed manually for the following areas:

  • applications
  • between the parties
  • criminal appeals
  • legal aid.
