Law Commission consults on enfranchisement

The Law Commission is seeking views on provisional proposals for a new, single enfranchisement regime designed to benefit leaseholders of both houses and flats. The proposed reforms will focus on buying a freehold and extending a lease

The Commission has now launched a consultation paper with four main categories of potential reform:

  1. What should the enfranchisement rights be?
  2. Who should be entitled to exercise enfranchisement rights?
  3. How should enfranchisement rights be exercised?
  4. What should it cost to enfranchise (notably the question of valuation premiums)?

Law Commission representatives will be holding regional information events in Cardiff, Southampton and Birmingham in late November to early December.

We encourage all members with an interest in the topics covered to respond to the consultation paper. The consultation closes on 7 January 2019.
