HMCTS has provided a list of common errors it has found in statement of truth applications.
From November 2018, executors no longer need to formally swear an oath before receiving a grant of representation. Instead, executors can apply for probate using a statement of truth (SoT), which will just need to be signed, not sworn.
The Winchester District Probate Registry has published a list of common errors (Word, 145KB) it has found in SoT appplications, which include:
- date of birth omitted
- medical evidence not supplied
- copies of LPAs not attached.
It has also provided us with some sample SoT documents for:

- residuary legatees and devisees – where the executor has renounced (Word, 23KB)
- cousins german of the whole blood (Word, 23KB)
