BIS: Non-compete clauses: call for evidence

In May 2016 the Department for Business Innovation and Skills published a consultation on non-compete clauses. This call for evidence sought views on whether non-compete clauses (restraint of trade) stifle entrepreneurship and innovation by preventing people from:

  • moving between employers
  • developing innovative ideas
  • creating a start-up
  • growing a business

The government wanted to hear views, experience, and evidence of non-compete clauses so that it could understand when and why they are used, their prevalence, the benefits or disadvantages associated with them.

The JLD is of the view that junior lawyers have been unfairly affected by the imposition of non-compete clauses in their employment contracts and have suffered both professionally and financially as a result.
