The Law Society will soon submit its position on the proposed deal to the European Commission DG of Trade and we would like to hear members’ views by 21 November.

The European Commission’s DG Trade has published its consultation on a Free Trade Agreement (FTA) with Indonesia. The closing date of the consultation is on Thursday, 1st December 2016 and the Law Society will be making a submission.

We are aware of numerous barriers and frustrations facing our members in Indonesia ranging from restrictive legal profession regulations, such as the fact that foreign lawyers need to be employed by an Indonesian law firm as consultants on foreign and international law in order to work in Indonesia, to issues in relation to processes and regulations originating from the Ministry of Law & Human Rights and the Ministry of Manpower.

If you wish to contribute to the Law Society’s submission, we would appreciate receiving your feedback before Monday, 21st November. You can find the text of the consultation on the DG Trade website. On the same page, you may also find the questionnaire used to collect input from industry stakeholders, which I have also attached to this email for your convenience.

The Law Society will be answering the questions from a legal profession perspective, so we kindly ask you to send information based on your firm’s legal business experience in Indonesia, and any matters directly related to the practice of law across borders, for example data flows.

We would be most grateful if feedback could be provided in the form of answers to the questions in the questionnaire (link above) and send it to gerwin.deboer@lawsociety.org.uk.

Your firm is of course free to make its own submission, or one on behalf of a client operating in a different industry. The latter will be helpful in demonstrating the positive role of lawyers in FTA negotiations.

We would also like to draw your attention to:

Indonesia Schedule of Commitments in the WTO GATS.

Indonesia Initial Offer in the DDA GATS Negotiations, and

ESF Assessment of the Indonesia Initial Offer.

These documents reflect the current state of play between the EU and Indonesia.

We look forward to reviewing your response.
