Malaysia: Mr Edmund Bon – Lawyer at risk

The Law Society is concerned by the recent opening of an investigation by police in Malaysia under the Sedition Act 1948 (“the Act”) against Mr Edmund Bon, an advocate at Bon Advocates in Kuala Lumpur, Malaysia.  Mr Bon has confirmed to news sources that an investigation under the Act has been opened against him in relation to an article of January 2014 in which he offered, in his capacity as a lawyer, legitimate legal analysis and commentary on a matter of public record relating to Malaysia’s Federal Constitution.  We note with concern reports of the application of the Act against a number of individuals in Malaysia, including lawyers who have in their professional capacity expressed legal opinions, and the risk this poses to freedom of expression in Malaysia.  We refer specifically to the grave concerns expressed by The Malaysian Bar in its Extraordinary Resolution of 19 September 2014 and by the United Nations Office of High Commissioner for Human Rights on 16 September 2014.  We also recall that we wrote to you on 17 March 2014 expressing our grave concerns regarding the conviction under the Act of the late Mr Karpal Singh.
